For income tax purposes how should i file?

I am married but my husband is undoented and gets paid either personal checks/cash. I don't want to be involved if this gets messy. But i want to get the best refund and i pay a lot in daycare expenses for my baby. I heard to claim childcare expenses you have to file married jointly?? any insight would be great! :)
